Tenant Rights Every Renter Should Know

Tenant law varies dramatically by jurisdiction, but certain core protections exist almost everywhere — and many of them cannot be waived, even by a signed lease.

The warranty of habitability is one. Landlords are obligated to provide a property that is safe, sanitary and fit for human occupation. This covers heat, hot water, structural integrity and pest control, among other things.

Quiet enjoyment is another. You have a right to use your rented home without unreasonable interference from the landlord. Non-emergency entry typically requires advance notice.

Security deposits are heavily regulated almost everywhere. There are rules about how much can be held, where it must be kept, what can be deducted, and how quickly it must be returned.

If you believe your rights are being violated, document everything in writing and send issues to the landlord by traceable mail. A paper trail is worth more than any verbal promise.
